SOLIOM TERMS OF SERVICE
OVERVIEW & BINDING ARBITRATION WARNING PLEASE READ THIS CAREFULLY. These Terms of Service ("Terms") govern your use of the Soliom website and products. SECTION 19 CONTAINS A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT WAIVES YOUR RIGHT TO A COURT HEARING OR JURY TRIAL.

SECTION 5 - PRODUCTS, SERVICES, AND "FINAL SALE" POLICY (CRITICAL UPDATE) Certain products or services may be available exclusively online through the website.

Accuracy: We have made every effort to display as accurately as possible the colors and images of our products. We cannot guarantee that your computer monitor's display will be accurate.

Limitation of Sales: We reserve the right to limit the sales of our products or Services to any person, geographic region, or jurisdiction.

FINAL SALE POLICY: Unless otherwise required by law, all items purchased using a discount code, promotional offer, or marked as "Sale," "Clearance," or "BOGO" are considered Final Sale and are non-refundable and non-exchangeable. By purchasing a discounted item, you expressly acknowledge that the standard 30-day return window does not apply.
SECTION 6 - BILLING & ACCURACY OF ACCOUNT INFORMATION We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store.
SECTION 7 - SHIPPING LIABILITY & RISK OF LOSS (NEW)

F.O.B. Origin: All purchases of physical items from Soliom are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier (FedEx/UPS/USPS).

Insurance Waiver: If you opt-out of Third-Party Shipping Insurance at checkout, Soliom bears no liability for lost, stolen, or damaged packages once they are in the possession of the carrier.
SECTION 13 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY (STRENGTHENED) TO THE FULLEST EXTENT PERMITTED BY LAW:

"AS IS" Basis: The service and all products are provided 'as is' and 'as available' for your use, without any representation, warranties, or conditions of any kind, specifically disclaiming any implied warranties of merchantability or fitness for a particular purpose.

No Liability for Data: Soliom shall not be liable for any loss of data, including but not limited to video footage or biometric templates stored locally on your device or SD card, resulting from hardware failure, network outage, or third-party cloud service interruptions.

Cap on Damages: In no case shall Soliom, our directors, officers, employees, or affiliates be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind. Our total liability to you for any damages shall not exceed the amount you paid Soliom for the applicable product.
SECTION 18 - GOVERNING LAW These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. (Updated from HK to US to enforce the Arbitration Act effectively).
SECTION 19 - DISPUTE RESOLUTION: MANDATORY ARBITRATION & CLASS ACTION WAIVER (CRITICAL) READ THIS SECTION CAREFULLY BECAUSE IT REQUIRES THE PARTIES TO ARBITRATE THEIR DISPUTES AND LIMITS THE MANNER IN WHICH YOU CAN SEEK RELIEF FROM SOLIOM.

Arbitration: Any dispute arising out of or relating to these Terms or our Products shall be finally settled by binding arbitration administered by the American Arbitration Association (AAA). You are giving up the right to litigate (or participate in as a party or class member) all disputes in court before a judge or jury.

Class Action Waiver: You and Soliom agree that any proceedings to resolve or litigate any dispute will be conducted solely on an individual basis. Neither you nor Soliom will seek to have any dispute heard as a class action, a private attorney general action, or in any other proceeding in which either party acts or proposes to act in a representative capacity.

Exception: Small claims court actions are permitted if they qualify.
SECTION 20 - BIOMETRIC DATA & PRIVACY By using Soliom products, you acknowledge and agree to our Privacy Policy, specifically regarding the collection and local storage of biometric data (facial recognition templates). You represent that you have obtained all necessary consents from individuals whose faces may be captured by your Soliom device as required by your local laws (including BIPA in Illinois).
